Privacy Policy 私隱政策


This Personal Data Privacy Policy (“the Privacy Policy”) illustrates the practice of FOODBOX ("We" or "Us" or "Our") in relation to our management of your personal data("Data") we collect from you through our websites and/or online services, including pickup-foodbox.hk and any other owned or operated websites, social media platforms and/or online services that link to the Privacy Policy (collectively the "Sites"). Any reference to "You" and "Your" when used in the Privacy Policy includes any person who accesses the Sites and/or submits Data.

Please read through the Privacy Policy carefully. By using the Sites or submitting your Data to us, you agree to accept the Privacy Policy. We have the right to change or amend the Privacy Policy at any time without prior notice. Any changes or amendments will be posted on the Sites. You are advised to check it on a regular basis. By continuing to use the Sites after the Privacy Policy is changed or amended, you are deemed to have consented to such changes or amendments.

1.     Personal Data (Privacy) Ordinance

       i.         In collecting, using, storing, retaining, disclosing, transferring, providing, allowing access to, protecting and accessing Data, we shall comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong SAR).

2.     Collection of Data and Information

       i.         When you use the Sites and/or create the account managed and operated by FOODBOX, we may collect Data including but not limited to the followings:

(a)   account and profile information that you provide when you register for an account or sign up for our products or services, for example Name, Email and Phone Number (collectively, “Account Data”);

(b)   information you provide through support channels, for example when you report a problem to us or interact with our support team, including any contact information, documentation, or screenshots (collectively, “Support Data”);

(c)    communication, marketing, and other preferences that you set when you set up your account or profile, or when you participate in a survey or a questionnaire that we send you (collectively, “Preference Data”);

(d)   information about your device or connection, for example your mobile device model, operating system version, unique device identifiers, and mobile network information and information we collect through cookies and other data collection technologies (please read our Cookies Policy for details) (collectively, “Technical Data”); and

(e)   Information about your use of or visit to our Platform, for example your browser type, domains, page views, duration, and information about the device you use to access the Services. (collectively, “Usage Data”).

      ii.         Your information will be used to:

·       for verification of identity and record for the purposes of recruitment, providing goods and services and/or customer services; 

·       to fulfill your order for goods or services and processing of such order, payment and any outstanding amounts;

·       to store contact details in our internal database;

·       to generate surveys on user traffic on the Sites;

·       to respond to and process any query from you or fulfill requests submitted by you;

·       for evaluation and further enhancement of our goods and services;

·       for conducting market surveys, research or analysis relating to our customers, goods, services, activities, promotions or events; or

     iii.         You acknowledge and agree that the provision of your Data to us is voluntary.

 

3.     Use of Data for Direct Marketing

       i.         We intend to use your Data for purpose of direct marketing by sending you the direct marketing communications, such as mail, email, telephone and SMS containing news, offers and promotions on food, beverage, catering products and services. We shall not use your Data for such purpose unless we have obtained your consent.

      ii.         We are not allowed to provide your Data to any third party for direct marketing purposes without your written consent.

     iii.         If you do not wish to receive any direct marketing communications from us, irrespective of whether you have participated the Membership or you have given your consent to us, you may send your request together with your name (registered one, if applicable), contact telephone number (registered one, if applicable) and email address (registered one, if applicable) to us via email at marketing@foodbox.hk marked to the attention of Customer Service Department indicating your request to cease using your Data for direct marketing purpose by us. 

4.     Security

       i.         We will use adequate security technologies and procedures to protect the Data from unauthorized access, use or disclosure. However, due to the nature of the Internet and technology, it is possible that others may intercept the information you are sending to or transmitting through the Sites. We do not warrant that the Sites are impenetrable or invulnerable to hackers.

5.     Disclosure, Retention and Storage of Data

       i.         You acknowledge, agree and authorize us to retain and store the Data in one or more of our databases within or outside Hong Kong.

      ii.         Except with your prior consent or as permitted by law, we will not transfer, disclose, provide or allow access of your Data to any third party except as stated below:

·       FOODBOX;

·       our employees;

·       credit companies for payment transactions;

·       any person or organization to whom we are required to make disclosure to 

(a)   in accordance with the requirements of applicable laws, court orders, administrative policies or regulations, guidelines or directives, 

(b)   orders given or issued by any regulatory, governmental, tax, law enforcement, other authorities, self-regulatory or industry bodies in or outside Hong Kong, 

(c)    in connection with any legal proceedings or 

(d)   for establishing exercising or defending legal rights in Hong Kong;

·       any person, organization or entity for the purpose of conducting due diligence in connection with our business, merger, acquisition or transfer of business;

·       any person, organization, entity or authority to facilitate identification of an individual involved in a life threatening or emergency situation; or

·       any agent, contractor or third party service provider who provides operation, research, sale, data analysis and processing, computer technology, telecommunication, telemarketing, payment or other services in connection with our business operation, provision of our goods and/or services and Membership management and operation.

     iii.         You acknowledge, agree and authorize us that we may transfer, disclose, provide or allow access your Data to execute, implement or comply with any term of our Terms and Conditions or the Privacy Policy.

     iv.         FOODBOX shall not keep your Data longer than is necessary for fulfilment of the purposes specified above for which they are, or are to be, used.

      v.         Data provided by you is retained if the purpose for which the Data was collected still exists, it is so required by law, statute or regulation, or it is in the public interest.

6.     Data Access and Correction

       i.         You are entitled to check whether we hold Data about you and to access any such Data, and if applicable, to require us to correct any inaccurate Data or update it. If you wish to access, correct or update your Data, please email support@foodbox.hk marked to the attention Customer Service Department. 

      ii.         If you wish to withdraw from Membership and/or request for removal or deletion of your Data, you may send your instruction/request together with your name (registered one, if applicable), contact telephone number (registered one, if applicable) and email address (registered one, if applicable) via email to us at support@foodbox.hk marked up the attention Customer Service Department.

7.     Cookies

       i.         We may use cookies on the Sites. Cookies are small bits of information that are automatically stored by a website on a person's web browser in his/her computer that can be retrieved by that website. The information collected by cookies is anonymous aggregated research data, and contain no name or address information or any information that will enable anyone to contact you via telephone, email or any other means. Most browsers are initially set up to accept cookies. Should you wish to disable those cookies you may do so by changing the settings on your browser. However, as cookies are necessary for some features of the Sites to work, e.g. to maintain continuity during a session, if they are disabled, those features may not work properly and this may cause some of our webpages to display incorrectly or not at all.

8.     Minors

       i.         We are not obliged to check or verify your age and assume that you are the age of 18 or above. If you are under the age of 18 or do not have the ability to enter into a contract, you should not provide any Data on the Sites without prior consent from your parents/guardians. Parents/guardians are advised to monitor their children/minors when they are online.
